Google, Apple pull further ahead of Microsoft in smartphone wars

Google and Apple are pulling even further ahead of Microsoft and RIM in the smartphone wars. According to the latest report from comScore, Google now controls 46.9 percent of the smartphone subscriber market in the U.S., up 3.1 percent from 43.8 percent for the three-month period ended in August.

Apple?s share, meanwhile, increased 1.4 percent to 28.7 percent.

The gains continue to come at the expense of BlackBerry maker RIM and Microsoft, whose mobile operating system now accounts for 5.2 percent of the market. That?s down 0.5 percent.

Can Microsoft regroup? A recent mobile?roadmap laid out the company?s plan to boost its market share next year, in part through the release of new ?superphones? in the fourth quarter of 2012.

ComScore?s study surveyed more than 30,000 U.S. mobile subscribers. In addition to the market share results for mobile platforms, the study also found Samsung to be the top handset manufacturer overall with 25.6 percent market share.

Samsung was?followed by LG with 20.5 percent share; Motorola with 13.7 percent share; and Apple with 11.2 percent share.

Euro weakens broadly; S&P 500 erases 2011 gains (Reuters)

NEW YORK (Reuters) ? The euro weakened about 1 percent against the dollar and the yen on Wednesday, one day before an important auction of long-dated Italian debt, while U.S. stocks slid more than 1 percent on concerns about the economy in early 2012.

The European single currency hit a fresh 11-month low against the dollar of $1.291 and a 10-year low against the yen as data showed banks were hoarding the cash recently injected by the European Central Bank rather than lending it out - a bad omen for the European economy in 2012.

"If European banks are still this concerned, it's not a good sign," said Karl Schamotta, senior markets strategist with Western Union Business Solutions. "That underlines the possibility that this liquidity crunch is getting worse and will continue into the new year.

A strong sale of short-term bonds by Italy Wednesday morning initially brought some relief to European markets, but concerns about Thursday's more challenging auction eventually contributed to the weakness of the euro.

U.S. stock indexes fell more than 1 percent in thin trading as investors feared what many expect to be a tough start to the year. The broad S&P 500 index erased its 2011 gains after just turning positive in last week's rally.

"It seems like the weakness in euro, breaking that $1.30 level, really made investors push that 'sell' button," said Ryan Detrick, senior technical strategist with Schaeffer's Investment Research in Cincinnati, Ohio.

"But it's somewhat of an exaggerated move, considering that there isn't much volume, and this could end in a one-day selloff."

The Dow Jones industrial average (.DJI) closed down 139.94 points, or 1.14 percent, at 12,151.41, while the Standard & Poor's 500 Index (.SPX) lost 15.79 points, or 1.25 percent, to 1,249.64. The Nasdaq Composite Index (.IXIC) fell 35.22 points, or 1.34 percent, to 2,589.98.

Wall Street's decline weighed on European stocks, which erased early gains. The FTSEurofirst 300 (.FTEU3) index of top European shares fell 0.71 percent to end at 983.32, after rising as much as 0.63 percent earlier in the session.

The MSCI All-Country World index (.MIWD00000PUS) lost 1.34 percent, taking losses for the year to more than 10 percent.

The decline in stocks lifted prices of U.S. government bonds. Benchmark 10-year Treasuries rose 22/32 in price, with the yield at 1.925 percent - below the psychologically significant 2 percent level.

ITALIAN AUCTIONS

The euro slid to a session low of $1.291, its lowest since January, as investors worried about Italy's sale of 8.5 billion euros worth of debt with maturities of up to 10 years on Thursday. It last traded 1.0 percent weaker at $1.2937.

Against the yen, the euro hit its lowest level since June 2001 at 100.70.

Earlier, the single currency briefly rose against the dollar after Italy's short-term debt costs halved at an auction, helped by a new government austerity package and cheap liquidity from the European Central Bank.

However, Italy will need greater commitment from international investors to sell its bonds on Thursday.

"Tomorrow's auction is more important and will give more insight into general sentiment. Today was a warm-up," said Neil Mellor, currency strategist at Bank of New York Mellon.

U.S. crude oil prices fell $1.98 to settle at $99.36 a barrel. They had gained more than one dollar in the previous session following Iran's threat to stop oil shipments through the Strait of Hormuz if Western countries impose new sanctions on its exports.

Tehran faces the prospect of further sanctions from the European Union by the end of January over its nuclear ambitions. Washington said it saw "an element of bluster" in the threat to close the Gulf, and the U.S. Fifth Fleet said it would not allow any disruption in the world's most important oil route.

"The threat by Iran to close the Strait of Hormuz supported the oil market yesterday, but the effect is fading today as it will probably be empty threats as they cannot stop the flow for a longer period due to the amount of U.S. hardware in the area," said Thorbjoern bak Jensen, oil analyst with Global Risk Management.

Girl Killed After Running On Freeway To Collect Lost Clothes

MIRA LOMA, Calif. -- Authorities say a 12-year-old girl was struck and killed on a Southern California freeway as she ran through traffic while attempting to retrieve clothing from the roadway.

The patrol says suitcases had fallen from the roof rack of the car that Flores was traveling in, scattering the clothes.

John Sullivan was driving about 70 mph when he saw the girl, but it was too late to avoid the collision. The 74-year-old wasn't injured or arrested.

Flores was pronounced dead at the scene.

Picayune and Biloxi dominated the Sun Herald?s All South Mississippi football team. The Maroon Tide and Indians each had three selections, tying the most of any Coast school.

    Monta Ellis Sexual Harassment: Warriors Guard, Team President Respond To Lawsuit

    Erika Ross Smith, a former Golden State Warriors employee, filed a sexual harassment lawsuit on Wednesday alleging that star guard Monta Ellis started sending her racy text messages in November 2010, one of which included a photo of his genitals. In the lawsuit, she also claims that the Warriors covered up for Ellis by changing her job description and eventually firing her after Ellis' wife learned of the texts and complained to the team in January of 2011.

    Shortly after Smith and her attorney, Burt Boltuch, held a press conference at his Oakland office, Warriors president Rick Welts issued a statement denying the allegations.

    "When we were made aware of a consensual relationship between Mr. Ellis and the plaintiff, we did what an organization should do. We told both to stop -- promptly, directly and fairly," he said. "The Warriors have never taken any action against the plaintiff for any inappropriate reason, and we deny the allegations she is making."

    Ellis also responded to the lawsuit, telling KTVU-TV that "it's a legal matter, we'll let it play its course."

    Boltuch, who revealed at the press conference a photo of what Smith claims to be Ellis' genitalia, fired back at Welts claiming that the relationship between his client and Ellis "was absolutely, unequivocally 100 percent not consensual."

    Boltuch told Deadspin that they showed the photo to reporters "so they would know we were serious."

    The 26-year-old, the team's captain and last year's leading scorer, scored 19 points and recorded six assists in Golden State's preseason loss to Sacramento on Tuesday night.

    Canon imageClass MF4570dw


    We don't usually review printers like the Canon imageClass MF4570dw ($299 direct) that are virtually identical to one we've already reviewed except for the addition of WiFi. We made an exception in this case primarily because the Canon imageClass MF4570dn ($299 direct originally, 4 stars) is an Editors' Choice, and we wanted to see if the MF4570dw, would be one as well. It isn't, but it comes close, and is certainly worth considering if you need a mono laser MFP for a small or home office.

    First, to avoid confusion about prices, note that the dw model is the same price that the dn model was when Canon first announced it. Since then, Canon's dropped the price on the MF4570dn to $249, making it an even better value. And one way to think about the dw is that it's the same printer with WiFi added for $50 extra. However, there are some other interesting differences.

    Canon is moving towards shipping all of its laser printers that include duplexing (two-sided printing) with their drivers set to duplex by default. This new approach started with the current crop of newly announced models, including the MF4570dw. Given that few people change settings for their drivers?which is why we run most of our tests using printer defaults?it's a good bet that most people will print with the default duplex setting. The best argument for this change to duplexing is that it helps make printing a little more eco-friendly, since it uses less paper. However, it also slows down print speed, and it creates at least one problem.

    When you set a printer for duplex, you also have to tell it whether to want the two sides printed so you can read the document by flipping the page on its long side, like a book, or short side, like a steno pad. The default setting on the Canon driver assumes you want to flip the pages along the long side, which is fine for pages you want to print in portrait mode, but the wrong way for my tastes for pages printed in landscape mode.

    I'd argue that if you are going to make duplex printing the default, you should also add separate settings for portrait and landscape modes for the direction to flip the page, and ask the user to choose the default flip settings during setup. Otherwise, odds are you'll forget to change the setting before printing with some regularity, have to reprint the document, and wind defeating the ecological benefit of having the duplex setting in the first place. So count the default duplexing as proving that Canon has good intentions, but didn't think through this particular change very well.

    Basics and Setup
    The MF4570dw shares the dn model's size, making it a little big to share a desk with, but reasonably compact, at 14.6 by 15.4 by 16.6 inches (HWD), and easy to find room for in the typical micro office or busy home office it's aimed at. Like the MF4570dn or the directly competitive Brother MFC-7860DW ($300 street, 3.5 stars), it can print, scan, and fax, even over a network, and work as a standalone copier and fax machine.

    It also offers a 35-page automatic document feeder (ADF) for scanning multipage documents as well as legal-size pages, which are too big for the flatbed. And with a 250-sheet input tray and 1-sheet manual feed, as well as the duplexer, it offers an appropriate level of paper handling for most micro or home offices. If you need more, however, you'll have to go elsewhere, since there are no options for additional trays.

    Setup is standard fare. For my tests I connected the MF4570dw to a wired network and installed the driver on a Windows Vista system.

    Speed and Output Quality
    Because of the default setting to duplex printing, the MF4570dw is a bit slower than the MF4570dn on our tests, but Canon rates the printer at the same 26 pages per minute (ppm) for simplex (one sided) printing, and 16 ppm for duplex.

    On our business applications suite, (using QualityLogic's hardware and software for timing), the printer managed an effective 9.8 ppm in its default duplex mode. Although that's slower than the MF4570dn, at 12.3 ppm, it's still reasonably fast. In fact, the printer essentially tied the MFC-7860DW, for example, at 9.7 ppm as well as the more expensive Editors' Choice Brother MFC-8480DN ($400 street, 4 stars) at 10.6 ppm. (Differences of 1 ppm or so on our tests aren't significant for lasers.) In addition, I ran the MF4570dw through the tests in simplex mode, and timed it at the same speed as the dn model.

    Not surprisingly, the MF4570dw offers essentially identical output quality to the MF4570dn. Text is a touch below par for a mono laser, which is still good enough so you shouldn't have any complaints unless you need a printer for serious desktop publishing or have an unusual need for small fonts. Graphics and photo output are both par for a mono laser MFP. For graphics, that means it's easily good enough for any internal business need. For photos, it's suitable for printing Web pages with recognizable photos or printing photos in client newsletters and the like.

    Much like the MF4570dn, the Canon imageClass MF4570dw offers all the features you need for a small or home office, reasonably good speed and output quality, and sufficient paper handling. And if you don't want to print in duplex, you can always change the default setting to simplex. If you don't need WiFi, the MF4570dn is obviously the better choice. If you do need it, you'll want to take a close look at the Brother MFC-8480DN as well, but the Canon imageClass MF4570dw is a more than reasonable choice and a potentially good fit for any micro or home office.

    Quirks galore in compressed NBA schedule

    There's stretches of three games in three nights. Some small-market teams won't host some of the league's elite teams this season, missing out on guaranteed sellouts that make the bottom line look better. Travel demands may be worse on clubs than ever before.

    It may be most quirky NBA schedule ever.

    The NBA lockout had many consequences. There were hundreds of lost games, not to mention hundreds of millions of lost dollars. Also lost was this _ the longstanding tradition that every team plays in every NBA city at least once over the course of the season.

    While teams will visit every other team in their own conference, they will only make trips to play nine clubs from the other side of the league instead of the usual 15.

    David Archuleta takes break from singing career to join Mormon mission

    David Archuleta was the runner-up on 'American Idol' and has released three albums, but the singer says he will take a two-year break from all of that to join mission for?The Church of Jesus Christ of Latter-day Saints.

    The contestant from the 2007-2008 season made the announcement during a Christmas concert Monday in downtown Salt Lake City, according to KSL.com. The 20-year-old Miami native, who grew up in Utah, said he's not quitting music, but feels a strong call to serve the church.

    A video of the concert on?Archuleta's?website shows him overwhelmed with emotion and crying as he talks about his plans. The crowd screams wildly with the news and gives him a standing ovation.

    "It's not because someone told me that I'm supposed to do it, and not because I no longer want to do music, but because it's the feeling that I've felt I need to do this with my life,"?Archuleta?told the crowd.

    Archuleta?was 16 and one of the youngest contestants when he competed on the seventh season of "American Idol." The runner-up has since released three albums, one of which debuted at No. 2 on the Billboard 200 chart.

    In 2010, he performed with the Grammy-winning Mormon Tabernacle choir at the group's annual Christmas concert.

    Church spokesman Eric Hawkins confirmed that?Archuleta?had been called on a mission by the faith. Hawkins said he didn't know when?Archuleta?was scheduled to report for missionary training.

    The location of?Archuleta's?mission has not been disclosed either by him or church officials.

    Statistics released in April show the church has more than 52,200 members currently are serving full-time proselytizing or service missions worldwide. About 75 percent of missionaries are men between 19 and 21. Single women over 21 and retired couples make up the remaining 25 percent.

    Single men typically serve for two years, and women and couples serve for 18 months.

    Missionaries volunteer for service, but must be selected by program officials in Salt Lake City. They are not paid and must cover their own expenses while in the field.

    The church has more than 350 missions worldwide.

    Report card 2011: Sony bats for solid average (Reuters)

    LOS ANGELES (TheWrap.com) ? This is the third in TheWrap's series of Studio Report Cards.

    Grade: B

    Sony fielded a string moderately budgeted hits from the likes of Cameron Diaz and Adam Sandler, while launching a new family franchise with "The Smurfs." Not every gamble paid off, with moviegoers giving a cold shoulder to "Anonymous," but by and large the formula worked.

    Sony left most of the major tentpole films to competitors such as Warner Bros. and Paramount, but what the studio did particularly well was hit for average.

    From "Bad Teacher" to "Just Go With It," Sony peppered the box office with a profitable string of doubles and singles.

    By and large, the formula worked, with Sony on pace to lap the $3 billion mark worldwide. It's only the third time that the studio has reached that pinnacle.

    Sony is currently in third place behind Paramount and Warner Bros. in terms of domestic theatrical market share, with just over $1.2 billion in receipts to date.

    "We didn't really have any sequels or established franchises, but we had some big wins and some really fresh pictures that exceeded our expectations," Jeff Blake, Sony's chairman of worldwide marketing and distribution, told TheWrap.

    The year also saw the introduction of a new family franchise for the studio. Produced for $110 million, "The Smurfs" racked up $561 million worldwide, doing particularly well in foreign markets. A sequel is already in the works.

    Made for a cost of just $20 million, the raunchy "Bad Teacher" cast Cameron Diaz as a money-grubbing, pot-smoking middle school teacher and rewarded the studio with a $216 million worldwide gross. Though slightly less successful, the sex and romance romp "Friends With Benefits" continued the string of low-cost hits, grossing $150 million worldwide on a $35 million budget.

    Matthew Harrigan, an analyst at Wunderlich Securities, says making films for underserved audiences, such as older moviegoers or women, is central to Sony's approach.

    "They are one of the studios that takes a very interesting approach on the counter-programming side," Harrigan said. "Obviously the big bright point in 2011 was 'The Smurfs' given the disproportionate international performance."

    Picking up international rights to Steven Spielberg's "The Adventures of Tintin" is proving to be a coup for the studio. The adaptation of Herg?'s comic strips has racked up $233.7 million worldwide so far, even though it has yet to debut stateside.

    Still on the docket and tracking strongly is "The Girl With the Dragon Tattoo," the adaptation of Stieg Larsson's bestselling novel, that Sony hopes will kick off a gritty R-rated franchise.

    "We have very high commercial expectations for the film," Blake said. "The book series was a phenomenon, and we think we have found the perfect director in David Fincher. We think we've really got something here."

    Blake thinks that with the film's Swedish setting, international markets will be as integral to the box-office performance as the domestic marketplace.

    Among its more modest hits, superhero comedy "The Green Hornet" racked up $228 million on a $120 million budget and alien invasion flick "Battle: Los Angeles" grossed $215 million on a $70 million budget, making them profitable, but far from otherworldly.

    Of course, not everything that Sony rolled out connected with audiences. Adam Sandler, who has become a fixture of the studio's slate, delivered a hit with the $215 million-grossing "Just Go With It." However, the critically derided "Jack & Jill" left moviegoers cold. With an $80 million budget, the film has so far eked out $83.6 million worldwide -- a rare whiff for Sandler.

    Not even Roland Emmerich could entice audiences into "Anonymous," a historical drama about the authorship of William Shakespeare's plays. The $30 million film landed with a thud, grossing just $14.2 million worldwide.

    Although its domestic performance has been disappointing, Sony is hopeful that "Arthur Christmas," produced Aardman Animations, will catch fire with younger moviegoers abroad as it continues its international rollout. The animated film has grossed $91.6 million worldwide, and has performed particularly well with United Kingdom audiences.

    All of this may just be a palate cleanser for 2012, when Sony rolls one of its most potent lineups in years. The studio is rebooting its wall-crawler franchise with "The Amazing Spider-Man," returning to its alien comedy series with "Men in Black III," and bringing back James Bond for "Skyfall."

    It also has a new "Ghost Rider" film, a reboot of "Total Recall" and fresh installments in its "Underworld" and "Resident Evil" franchises on tap.

    "We've got our biggest franchise on display," Blake said. "As happy as we are to go over $3 billion worldwide, I think we've got the ingredients to go well beyond that next year.

    (AP) ? The U.S. military opened its pretrial hearing for accused leaker Army Pfc. Bradley Manning on Friday in a heavily secured courtroom where Manning, dressed in his Army camouflage fatigues, made his first public appearance.

    The hearing, the rough equivalent of a civilian grand jury proceeding, is to determine whether Manning will be court-martialed on charges that he stole an enormous trove of government secrets and caused them to be made public on the Internet.

    He is suspected of giving the documents to WikiLeaks, the anti-secrecy website that last year began publishing the materials.

    The case has spawned an international movement in support of Manning, who is seen by anti-war activists as a hero who helped expose American mistakes in Iraq and Afghanistan. To others he is a villain, even a traitor, who betrayed his oath of loyalty by deliberately spilling his government's secrets.

    If his case goes to trial and he is convicted, Manning could face life in prison. The government has said it would not seek the death penalty.

    A U.S. military legal expert told reporters shortly before the proceedings began that the presiding officer is likely to make his recommendation on whether to court-martial Manning within eight days after the hearing ends. The hearing is expected to last over the weekend and possibly well into next week.

    Manning, 23, was at the defense table along with his civilian lawyer, David Coombs, and two other Army lawyers.

    Manning's lawyer asserts that the documents' release did little actual harm.

    The legal expert, who could not be identified under Army ground rules, said Manning is to be present for all proceedings, including sessions closed to the public for consideration of classified material.

    Manning's supporters planned to maintain a vigil during the hearing and were organizing a rally for Saturday.

    Fort Meade, located between Washington and Baltimore, is, ironically, home to U.S. Cyber Command, the organization whose mission includes protecting computer networks like the one Manning allegedly breached by illegally downloading huge numbers of classified documents in Iraq.

    The hearing at Fort Meade is intended to yield a recommendation to Army Maj. Gen. Michael S. Linnington, commander of the Military District of Washington, on whether Manning should be court-martialed. Linnington could choose other courses, including applying an administrative punishment or dismissing some or all of the 22 counts against Manning.

    On Thursday, Secretary of State Hillary Rodham Clinton called Manning's alleged actions damaging and unfortunate.

    "I think that in an age where so much information is flying through cyberspace, we all have to be aware of the fact that some information which is sensitive, which does affect the security of individuals and relationships, deserves to be protected and we will continue to take necessary steps to do so," Clinton told reporters at the State Department.

    The Manning case has led to a debate over the broader issue of whether the government's system for classifying and shielding information has grown so unwieldy that it is increasingly vulnerable to intrusions.

    Absent from the Meade proceedings will be Julian Assange, who runs WikiLeaks from England. He is fighting in British courts to block a Swedish request that he be extradited to face trial over rape allegations.

    A U.S. grand jury is weighing whether to indict Assange on espionage charges, and WikiLeaks is straining under an American financial embargo that Assange says has starved it of revenue.

    The materials Manning is accused of leaking include hundreds of thousands of sensitive items: Iraq and Afghanistan war logs, State Department cables and a classified military video of a 2007 American helicopter attack in Iraq that killed 11 men, including a Reuters news photographer and his driver.

    At the time, Manning was a low-level intelligence analyst in Baghdad.

    Manning, who turns 24 on Saturday, was detained in Iraq in May 2010 and moved to a Marine Corps brig at Quantico, Virginia, in July. Nine months later, the Army sent him to the military prison at Fort Leavenworth, Kansas, after a series of claims by Manning of unlawful pretrial punishment.

    When it filed formal charges against Manning in March 2011, the Army accused him of using unauthorized software on government computers to extract classified information, illegally download it and transmit the data for public release by what the Army termed "the enemy."

    The first large publication of the documents by WikiLeaks in July 2010, some 77,000 military records on the war in Afghanistan, made global headlines. But the material provided only limited revelations, including unreported incidents of Afghan civilian killings as well as covert operations against Taliban figures.

    In October 2010, WikiLeaks published a batch of nearly 400,000 documents that dated from early 2004 to Jan. 1, 2010. They were written mostly by low-ranking officers in the field cataloging thousands of battles with insurgents and roadside bomb attacks, plus equipment failures and shootings by civilian contractors. The documents did not alter the basic outlines of how the war was fought.

    A month later, WikiLeaks released hundreds of thousands of State Department documents that revealed a hidden world of backstage international diplomacy. They divulged candid comments from world leaders and detailed occasional U.S. pressure tactics aimed at hot spots in Afghanistan, Iran and North Korea.

    Last month, 54 members of the European Parliament signed a letter to the U.S. government raising concerns about Manning's lengthy detention. They questioned whether his right to due process has been violated by keeping him in pretrial confinement for 18 months.

    It took months for the Army to reach the conclusion that Manning was competent to stand trial. In the meantime Manning's civilian lawyer, David E. Coombs, has sought to build a case that appears to rest in part on an assertion that the government's own reviews of the leaks concluded that little damage was done.

    Indeed, the Pentagon determined in August 2010 that the initial leaks had not compromised intelligence sources or practices, although it said the disclosures could still cause significant damage to U.S. security interests.

    (AP) ? It's a startling number: 1 in 4 women surveyed by the government say they were violently attacked by their husbands or boyfriends.

    Experts in domestic violence don't find it too surprising, although some aspects of the survey may have led to higher numbers than are sometimes reported.

    Even so, a government official who oversaw the research called the results "astounding."

    "It's the first time we've had this kind of estimate" on the prevalence of intimate partner violence, said Linda Degutis of the Centers for Disease Control and Prevention.

    The survey, released by the CDC Wednesday, marks the beginning of a new annual project to look at how many women say they've been abused.

    One expert called the new report's estimate on rape and attempted rape "extremely high" ? with 1 in 5 women saying they were victims. About half of those cases involved intimate partners. No documentation was sought to verify the women's claims, which were made anonymously.

    But advocates say the new rape numbers are plausible.

    "It's a major problem that often is underestimated and overlooked," said Linda James, director of health for Futures Without Violence, a San Francisco-based organization that advocates against domestic abuse.

    The CDC report is based on a randomized telephone survey of about 9,000 women and 7,400 men.

    Among the findings:

    ? As many as 29 million women say they have suffered severe and frightening physical violence from a boyfriend, spouse or other intimate partner. That includes being choked, beaten, stabbed, shot, punched, slammed against something or hurt by hair-pulling.

    ? That number grows to 36 million if slapping, pushing and shoving are counted.

    ? Almost half of the women who reported rape or attempted rape said it happened when they were 17 or younger.

    ?As many as 1 in 3 women have experienced rape, physical violence or stalking by an intimate partner in their lifetimes, compared to about 1 in 10 men.

    ?Both men and women who had been menaced or attacked in these ways reported more health problems. Female victims, in particular, had significantly higher rates of irritable bowel syndrome, asthma, frequent headaches and difficulty sleeping.

    ?Certain states seemed to have higher reports of sexual violence than others. Alaska, Oregon and Nevada were among the highest in rapes and attempted rapes of women, and Virginia and Tennessee were among the lowest.

    Several of the CDC numbers are higher than those of other sources. For example, the CDC study suggests that 1.3 million women have suffered rape, attempted rape or had sex forced on them in the previous year. That statistic is more than seven times greater than what was reported by a Department of Justice household survey conducted last year.

    The CDC rape numbers seem "extremely high," but there may be several reasons for the differences, including how the surveys were done, who chose to participate and how "rape" and other types of assault were defined or interpreted, said Shannan Catalano, a statistician with the Bureau of Justice Statistics.

    "It is an evolving field, and everyone is striving to get a handle on what's the best estimate," Catalano said.

    The CDC's numbers don't seem surprising to people who work with abused women.

    "I think that the awareness is growing," said Kim Frndak, community educator for the Women's Rescue Center to End Domestic Violence, which operates a shelter on the outskirts of Atlanta.

    "More and more people are really saying, 'Oh, this is something that we need to pay attention to as well,' because it's your sister, it's your mother, it's your daughter, it's your son, it's your brother. Someone in your own circle is being affected by domestic violence, and the effects can be devastating," she said.

    Lam Research buying Novellus Systems in $3.3B deal (AP)

    SAN FRANCISCO ? Semiconductor equipment maker Lam Research Corp. is buying rival Novellus Systems Inc. for $3.3 billion in stock, the companies announced Wednesday.

    Lam said that the acquisition will help it cultivate more advanced chip making technology and increase its revenue faster than either company could on its own. The company also expects it to speed up its earnings growth.

    Novellus Systems Inc. stockholders will get 1.125 shares of Lam common stock for each Novellus share. The deal values Novellus at $44.42 per share, based on Lam's Wednesday closing price. That's 28 percent higher than Wednesday's $34.70 closing price for Novellus' common shares.

    The companies said Lam shareholders will own 59 percent of the combined company and Novellus shareholders 41 percent.

    Lam and Novellus expect the deal to be finalized in the second quarter of 2012, and to lead to $100 million in cost savings on an annualized basis by late 2013.

    Along with the purchase announcement, Lam said Wednesday that it will buy back as much as $1.6 billion worth of its common stock. The company said that if it buys back the full amount of stock covered under the plan, it will affect the company the same way financially as if the Novellus acquisition were composed of 48 percent cash and 52 percent stock.

    Lam reiterated its previous announcement that current president and chief operating officer Martin Anstice will take over as CEO in January when current CEO Steve Newberry departs.

    The companies also said Wednesday that Novellus COO Timothy Archer will become COO of the combined company, and Lam's board will bring on four directors nominated by Lam and Novellus.

    Shares of Fremont-based Lam fell $1.48, or 3.8 percent, to $38 after hours, after ending regular trading down 70 cents at $39.48.

    Shares of Novellus, which is based in San Jose, climbed $6.75, or 19.5 percent, to $41.45 after hours, having ended regular trading down 61 cents at $34.70.

    TPG buys NZ$70 million debt in New Zealand media firm (Reuters)

    MELBOURNE (Reuters) ? Private equity fund TPG Capital has bought NZ$70 million ($53 million) of the debt of New Zealand media company MediaWorks from Commonwealth Bank of Australia (CBA), according to a source familiar with the matter.

    MediaWorks, like Nine Entertainment in Australia, was acquired by a private equity fund at the height of the buyouts boom using leveraged debt.

    CBA's NZ$70 million in MediaWorks was part of the leveraged buyout facilities that Australian private equity firm Ironbridge Capital used to buy MediaWorks for around NZ$800 million in 2007.

    Both Nine and MediaWorks were subsequently hit by falling advertising revenues, have had their debt restructured and have seen original bank lenders selling their debt.

    In recent weeks, banks, including CBA, have sold increasing amounts of Nine Entertainment debt to hedge funds, causing owner CVC Asia Pacific to cancel two restructuring proposals in less than a week.

    TPG, which last year led the debt-for-equity recapitalization of ailing utility Alinta Energy, now holds around 20 percent of the senior loans of MediaWorks, according to the source.

    Australian print publication AFR earlier reported the TPG acquisition of debt.

    TPG declined comment. CBA was not immediately available for comment.

    MediaWorks, which has free-to-air television channels and a radio network, previously went through a debt restructuring in 2010 which saw Goldman Sachs swap out its debt in the company for an equity stake, according to media reports at the time.

    Original lenders to the NZ$555 million facilities backing the Ironbridge buyout in 2007 included Bank of Scotland International, the then ABN AMRO Bank, Royal Bank of Scotland, Bank of New Zealand, Rabobank and Westpac Banking Corp, according to Thomson Reuters LPC.

    Syria says it is still open to Arab observer plan (AP)

    BEIRUT ? Syria said Sunday that it is negotiating with the Arab League to allow observers into the country, as Arab leaders prepare to tighten sanctions slapped on the regime for its crackdown on an 8-month-old uprising.

    Arab leaders have given Syria a new deadline ? Sunday ? to respond to the League peace plan, which calls for the admission of observers to prevent regime violence against protesters.

    Syria's failure to meet a Nov. 25 deadline to allow observers saw the imposition of a raft of measures, including a ban on dealings with the country's central bank.

    In addition to sanctions imposed by Western countries, the Arab measures are expected to deal significant damage to Syria's economy and may undercut the regime's authority.

    Syria is now signaling that it might still be willing to comply with the Arab League's peace plan, and that its objections to the plan are simply a matter of details.

    "Messages are being exchanged between Syria and the Arab League to reach a certain vision that would facilitate the mission of observers in Syria, while preserving Syrian interests and sovereignty," Foreign Ministry spokesman Jihad Makdissi told reporters in Damascus.

    Damascus may simply be playing for time. Qatar's prime minister said Saturday during a meeting of Arab foreign ministers in the Gulf country's capital Doha that he expected Syrian envoys to sign an agreement on Sunday.

    Sheik Hamad Bin Jassem Bin Jabr Al Thani said that failure to reach an agreement may lead to U.N. involvement in the Syrian crisis, although he did not spell out what that meant.

    Arab ministers have continued to meet to work out enforcement of the existing sanctions package.

    Some sanctions ? the central bank ban, a halt to Arab government funding of projects in Syria, and a freezing of Syrian government assets ? went into effect immediately.

    Saturday's Arab ministerial meeting was intended to work out further details of the sanctions, including a list of 19 Syrian officials subject to a travel ban.

    Among them are President Bashar Assad's younger brother Maher, who is believed to be in command of much of the crackdown, as well as Cabinet ministers, intelligence chiefs and security officers. The list does not include the president himself.

    The punitive action is meant to pressure the Syrian regime to stop its crackdown on an 8-month-old uprising in which more than 4,000 people have been killed.

    The revolt against Assad's rule began with peaceful protests in mid-March, triggering a brutal crackdown. The unrest has steadily become bloodier as defectors and some civilians take up arms, prompting the United Nations' human rights chief to refer to it this week as a civil war and urge the international community to protect Syrian civilians.
